1. Scope
The following General Terms and Conditions (GTC) apply to all orders placed via our website. The offer on this website is aimed exclusively at consumers resident in Switzerland (hereinafter "customer").
A consumer is a natural person who has business relations with LOREVA that cannot be attributed to their commercial or self-employed professional activity. Orders in quantities not customary for a household may be refused without giving reasons.
LOREVA reserves the right to change these GTC at any time. The version of these GTC valid at the time of the order applies and cannot be changed unilaterally for that order. Conflicting or deviating terms of the customer are not recognised.
The operator of this website is LOREVA.
2. Information on this website
The website contains information about products and services. Changes to prices and range as well as technical changes are reserved. All information on this website (product descriptions, images, illustrations, films, dimensions, weights, technical specifications, accessory compatibility and other information) is for illustration purposes, is to be understood as approximate and is non-binding. In particular, it does not constitute any assurance of properties or guarantee unless explicitly stated otherwise. LOREVA endeavours to provide all information on this website correctly, completely, up to date and clearly, but cannot guarantee this either expressly or implicitly.
All offers on this website are subject to change and are not to be understood as binding offers.
LOREVA cannot guarantee that the listed products will be available at the time of ordering. All information on availability and delivery times is therefore without guarantee and may change at any time without notice.
3. Prices
The stated sales prices are final prices and, unless otherwise stated, include statutory VAT and any other statutory charges such as advance recycling fees (ARF) or copyright levies on electronic devices. Prices are net in Swiss francs (CHF).
Any shipping costs are, unless otherwise provided, charged additionally and are to be paid by the customer. Shipping costs are shown separately during the ordering process.
Technical changes, errors and misprints are reserved; in particular, LOREVA may change prices at any time without prior notice. Sales prices do not include any advice or support services.
4. Conclusion of contract
The products and prices on this website are non-binding offers.
By placing an order via this website, including accepting these GTC, the customer submits a legally binding offer to conclude a contract. LOREVA then sends an automatic order receipt confirmation by email confirming that the customer's offer has been received. Orders placed are binding for the customer. Unless otherwise stated, there is no right of return or withdrawal.
The contract is concluded as soon as LOREVA sends a declaration of acceptance by email confirming the shipment of the ordered products or services.
Orders are only delivered after full receipt of payment (exception: delivery on invoice) and provided the goods are available. If it turns out that the ordered goods cannot be delivered or cannot be delivered in full, LOREVA is entitled not to accept or to only partially accept or execute the order. In such a case, LOREVA will inform the customer by email. If the customer's payment has already been received, it will be refunded. If no payment has yet been made, the customer is released from the obligation to pay.
5. Payment options
The payment options shown during the ordering process are available to the customer.
LOREVA reserves the right to exclude customers from individual payment options without giving reasons or to insist on payment in advance.
In the event of late payment, LOREVA may charge default interest of 5% per year and a reminder fee of up to CHF 20.- per reminder.
Retention of title:
The products delivered to the customer remain the property of LOREVA until paid in full.
6. Delivery, duty to inspect, notice of defects and returns
Deliveries are sent by post or courier service to the address specified by the customer in the order.
LOREVA endeavours to keep delivery times as short as possible. However, any delivery times stated in the order confirmation are non-binding. LOREVA is entitled to make partial deliveries. In this case, the customer is only charged shipping costs once.
Where delivery on invoice is offered, the invoice is sent by email or by post at LOREVA's discretion.
If the delivery cannot be delivered or the customer refuses to accept it, LOREVA may terminate the contract after notifying the customer by email and granting a reasonable grace period, and may charge the costs incurred.
The customer is obliged to inspect the delivered goods immediately upon receipt and to report any defects for which LOREVA is liable without delay in writing by email to the address stated in the legal notice.
Returns to LOREVA are at the customer's expense and risk. The customer must send the goods in their original packaging, complete with all accessories and together with the delivery note and a detailed description of the defects, to the address provided by LOREVA. The return address will be sent to the customer by email on request.
If LOREVA's inspection shows that the goods have no detectable defects or that these are not covered by the manufacturer's warranty, LOREVA may charge the customer for the effort, the return shipment or any disposal.
7. Right of withdrawal
The customer has the right to withdraw from the contract within 14 calendar days of receiving the goods. The deadline is met if the written withdrawal is sent to LOREVA by email within this period. Exercising the right of withdrawal leads to the contract being reversed.
Return conditions
Items can be returned within 14 days of receipt. The items must be unused, unopened and in the same condition as when they were received. Please always contact our customer service before returning an item. After checking the returned goods, the purchase price will be refunded. After the 14-day period, we are unfortunately no longer able to offer a refund or exchange. Further information on returns is available from customer service.
Important note on sale items:
Sale items are excluded from returns, even if they are within the stated period of the money-back guarantee.
Return conditions for a refund
Return of a non-defective, unopened item:
- Product in its original packaging and undamaged
- Item received no more than 14 days ago
- Condition checked in our warehouse
- Full refund (100%) of the purchase price
No right of return:
- On reduced items
- Product in opened or damaged original packaging
- Used products
- Products without original packaging
- Included accessories missing
- Opened consumables
- Return period expired
- Hygiene items (underwear, tights, socks)
Refunds
As soon as we have received and checked your return, we will inform you by email of its receipt and of whether it has been accepted or rejected. If the return is accepted, the refund is made automatically within 20 days to your originally chosen payment method.
Late or missing refunds
If you have not yet received a refund, please first check your bank account and then contact your credit card company. It may take some time before the refund is officially posted. If you still have not received your refund, please contact our customer service.
Shipping of returns
Shipping costs for returns are currently borne by you. Shipping costs for the original delivery are not refunded.
Wrong item
If you have received a wrong item by mistake, please first check carefully that the delivered product does not match one of the items you ordered. If you have indeed received a wrong item, please contact us immediately.
Transport damage
If your order was damaged during transport, please contact our support.
Cancellation conditions
Orders can be cancelled by email up to 48 hours after the time of order, provided the order has not yet been shipped. Once the order has been shipped, cancellation is no longer possible.
8. Warranty
LOREVA endeavours to deliver goods of flawless quality. For defects reported in good time, LOREVA warrants for 14 days after receipt of the goods that the item purchased by the customer is free from defects and functional. It is at LOREVA's discretion to fulfil the warranty by free repair, equivalent replacement or refund of the purchase price. Further warranty rights are excluded.
The warranty does not cover normal wear and tear, the consequences of improper handling or damage by the customer or third parties, or defects attributable to external circumstances. The warranty for consumable and wearing parts (e.g. batteries, rechargeable batteries, etc.) is also excluded.
LOREVA cannot give any assurances or guarantees regarding the timeliness, completeness and accuracy of the data or the constant or uninterrupted availability of the website, its functionalities, integrated hyperlinks and other content. In particular, it is neither assured nor guaranteed that the use of the website does not infringe the rights of third parties not owned by LOREVA.
9. Liability
LOREVA excludes all liability, regardless of its legal basis, as well as claims for damages against LOREVA and against any auxiliary persons and agents. In particular, LOREVA is not liable for indirect damage and consequential damage, lost profit or other personal injury, property damage and pure financial loss of the customer. Further mandatory statutory liability, for example for gross negligence or unlawful intent, remains reserved.
LOREVA uses hyperlinks solely to give the customer easier access to other web offerings. LOREVA can neither know the content of these web offerings in detail nor assume liability or any other responsibility for the content of these websites.
10. Data protection
LOREVA may process and use the data collected in the course of concluding the contract to fulfil its obligations under the purchase contract and for marketing purposes. The data necessary for performance may also be passed on to commissioned service partners (logistics partners) or other third parties.
11. Partial invalidity
Should individual provisions of these GTC prove to be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected.
12. Other provisions
LOREVA expressly reserves the right to change these GTC at any time and to put them into effect without notice.
In the event of disputes, substantive Swiss law applies exclusively, excluding the rules on conflict of laws. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is expressly excluded.
